Terms and Conditions of Use

Our attorneys tell us we must publish the following:

Rainbow Destinations (hereafter called "The Directory") is an on-line listing of gay friendly Bed & Breakfasts, Country Inns, Guesthouses, Hotels, Resorts, and other properties. Cimarron Technology, , maintains The Directory as a service to the Internet gay and lesbian community. Use of The Directory is subject to the following terms and conditions. Cimarron Technology may revise these terms and conditions from time to time by updating this posting.

The entire content of The Directory is copyrighted, and all rights are reserved. You may save to disk or print out individual or small selections of listings for your own use, provided that you do not collect multiple small selections for the purpose of replicating all or substantial portions of The Directory. The Directory may be displayed by you to limited numbers of persons provided that you do not charge for such a presentation.

Please note that the information and the photographs in each listing of The Directory are provided and paid for by the property listed. Each user of The Directory agrees to look solely to the property, and not Cimarron Technology or Blackburn Enterprises, Inc., for any warranty, refund, guaranty, or other claim regarding any product or service furnished or ordered. Cimarron Technology does not investigate any of the parties whose sites are listed in The Directory, and does not make any guaranty or warranty or assume any liability or responsibility for any such party, nor can Cimarron Technology assist in complaints by any user of any such party.

Cimarron Technology will use reasonable efforts to include accurate and up to date information in The Directory, but all users and persons submitting listings agree that all use of The Directory is at your own risk. Neither Cimarron Technology nor any property, information or service provider or other party listed in the directory, nor any other party involved in creating, producing or delivering the directory, shall be liable for any direct, incidental, consequential, indirect or punitive damages arising out of your use or inability to use the directory, any errors or omissions in the listings, or the products and services obtained by you.

This is an offer to provide services, and acceptance is expressly conditioned upon your acceptance of these terms and only these terms. This agreement represents the entire agreement between you, Cimarron Technology and Blackburn Enterprises, Inc. and supersedes any and all other communications, prior, contemporaneous or subsequent, and any course of performance or course of dealing, except as modified by a written agreement signed by an authorized official of Cimarron Technology and Blackburn Enterprises, Inc., or by Cimarron Technology revising this posting (provided, however, that any such revised posting shall take effect prospectively from the date of such posting).

This agreement shall be in effect from your first use of The Directory. Cimarron Technology reserves the right to deny access to any user, however, the disclaimers and limits of liability above shall survive termination for any reason. This agreement shall be governed by the laws of the State of Texas, as a contract made and performed in that state.
